In certain child support and custody cases when the father of the child is unknown or in question, the state can order a paternity DNA test be taken to confirm the identity of the actual father. The courts will then use the results of the DNA test as evidence of the father’s identity.

Although completely unrelated, the primary issues in regards to paternity cases is typically the father’s responsibility to make the required child support payments and his right to visitation. If the father does not make the court ordered child support payments, the mother cannot refuse visitation to him unless the courts order so. The father may also not refuse to pay the support payments to the mother because she is refusing the court ordered visitation.
